And So It Begins
On March 24, the Choctaw and Chikasaw Nations filed actions in Oklahoma state court for declaratory judgment against their multiple insurers seeking a ruling that the insurers are obligated to reimburse losses and expenses the Nations have incurred due to closure of their casinos. The petitions describe their policies as all risk, including business interruption, interruption by civil authority, and limitation of ingress and egress. There is no indication that the Nations have actually submitted claims or what position the insurers have taken, but it is probably reasonable to anticipate that insurers will be denying these claims by the thousands. We will continue to keep on eye on this space and report on significant developments.
